• Probable outcomes of dvc and hmop

FACTUAL BACKGROUND:
1. Marriage & Child: Parties married; daughter born in June 2019 (currently 7 years old).
2. First Desertion & Mental Health (2020): Mother left the matrimonial home leaving the child with the father following a suicide attempt, citing treatment for bipolar disorder at her maternal home. The child remained in the father's continuous, exclusive physical custody.
3. Prior Maintenance Rejection (Sept 2022): Mysore Family Court rejected/quashed the wife’s maintenance claim after both agreed to resume cohabitation.
4. Second Desertion (Feb 14, 2023): After ~5 months of cohabitation, the wife again left for her maternal home, voluntarily leaving the minor daughter behind with the father.
5. Parallel Divorce Petitions (May 2023): Both parties filed for divorce. In her divorce petition, the wife claimed ₹1 crore permanent alimony but omitted any prayer for child custody.
6. Subsequent Inconsistent Pleadings (Late 2023): In the husband's divorce petition (HMOP), the wife filed for Restitution of Conjugal Rights (RCR) along with Interim Applications (IAs) seeking interim custody of the child, interim maintenance, and return of jewels.
7. Domestic Violence Case: She also initiated proceedings under Section 12 of the Protection of Women from Domestic Violence Act, 2005 (DVC) seeking monetary relief. The husband's parents have already been quashed/removed from the DVC.
8. Mediation & Current Status: Husband has cooperated with court processes; mediation was attempted but disrupted offline by opposing counsel. The minor daughter has now lived with the father for ~6 of her 7 years and is well-settled in his primary care and schooling.

PROPOSED STRATEGY:
1. Seek dismissal/quash/stay or dropping of proceedings for the husband under the Domestic Violence Act, 2005 (or dispense with his personal appearance).
2. File a petition before the High Court under Article 227 / Section 21B of the Hindu Marriage Act, 1955 for time-bound, speedy disposal of his HMOP.

SPECIFIC LEGAL QUESTIONS:
1. Child Custody on Interim Application: Given that the child is 7 years old, the mother twice voluntarily deserted the child, omitted custody in her own divorce petition, and has a documented history of a suicide attempt/bipolar treatment, will the Family Court grant physical custody to the mother when her IA is examined, or will status quo with visitation be maintained?
2. Impact of Speedy Disposal on IAs: What will be the procedural and substantive fate of the three pending IAs (interim custody, Section 24 maintenance, return of jewels) if the High Court directs expedited disposal of the main HMOP?
3. Risks & Adverse Impact: Can seeking to quash/stay/drop the DVC and expediting the HMOP adversely affect the husband in any way?
4. Tactical Assessment: How viable are defenses based on her mutually destructive pleadings (seeking divorce while claiming RCR) and the prior dismissal of maintenance by the Mysore

Mother would not be granted  physical custody of child but visitation. Rights .she is suffering from bipolar disorder and has abandoned child

2) family courts are over burdened with cases .expedited hearing chances are bleak

3) it would not affect husband adversely

4) wife cannot seek divorce and file for RCR

5) personal appearance of husband is not necessary in DV case if he is represented by advocate

Under Section 13 of the Hindu Minority and Guardianship Act, 1956, the paramount consideration is the welfare and best interest of the child, not statutory parental preferences. The minor is 7 years old and has spent ~6 years exclusively under your care. Courts strongly resist uprooting a child from an established, stable routine, schooling, and living environment during interim proceedings.

The mother’s conduct of voluntarily abandoning the child twice (in 2020 and Feb 2023) and omitting any custody prayer in her own primary divorce petition creates a heavy factual presumption that she acquiesced to your primary caretaking role.

While clinical mental illness (bipolar disorder/suicide attempt) is not an automatic bar to parenting, proven medical vulnerability coupled with past abandonment presents a safety/stability risk. The court will not risk disruption without comprehensive psychiatric evaluations and trial.

A Family Court cannot legally jump straight to trial while interim applications remain pending. The court will be forced to dispose of the Section 24 Maintenance IA, Interim Custody IA, and Return of Jewels IA on an expedited, day-to-day hearing schedule.

Interim custody will be formalized as status quo with visitation. The IA for return of jewels (Stridhan) will either be decided on prima facie affidavits or merged with the main trial issues if factual claims are heavily disputed.

High Courts exercise caution under Section 482 CrPC (or Section 528 BNSS) to quash DVC cases against the primary spouse (husband) if factual allegations exist, even if vague. If your quash petition is dismissed, it may consume time, incur costs, and give the opposing party a psychological advantage.

Rather than seeking an outright stay of proceedings, file for dispensation of personal appearance for routine dates and press for speedy cross-examination. Since your parents are already discharged/quashed, the case scope is narrowed strictly to you.

Seeking RCR while alleging severe domestic violence and demanding ₹1 Crore permanent alimony in her own petition highlights an inherent contradiction. You can argue that her plea for RCR is not genuine, but merely a defensive posture to counter your divorce petition and extract monetary settlements.

The September 2022 rejection/quashing of maintenance applies strictly to the period prior to cohabitation. It does not bar her from claiming maintenance post-February 2023 under changed circumstances.

File income affidavits per Rajnesh v. Neha immediately. Oppose the interim custody IA by highlighting the 6-year status quo, her medical history, and voluntary desertions, while offering reasonable, structured visitation.
