• Transfer of property shares via a registered gift deed Mumbai

There is an administrator in our society who has given letter that he don’t have authority to transfer of property shares and it can be done through registrar only via a appeal to society registrar at malhotra house. Pls guide how to proceed as the property was in a joint name between me and my wife and she as gifted me her rights via registered gift deed. Is there any appeal format which I need to submit at registrar office for transfering of property shares? I have already submitted all affidavits and formats to society which were required by society as per bye-law but administrator can’t approve as per his power. Pls advise how to proceed with registrar office and any application format / appeal letter required which needs to be submitted at registrar office

Once gift deed is executed duly stamped and registered you are absolute owner of flat 

 

2) if administrator is declining to transfer share certificate of flat in society approach registrar in this regard 

 

3) there is no specific format 

 

4) visit registrar office personally

Request registrar to transfer share certificate in your name 

 

enclose copy of documents submitted to society 

 

mention that administrator had declined to transfer share as he had no powers to do so

If the administrator is not cooperating or if he has really no power to transfer the shares of the property in the housing society,  you may ask him to give it in writing. 

After that you can file a complaint with the local registrar, and this can be sorted with the interference of Registrar.

The property situated in a society can be transferred only by way of a registered sale deed like any other property . However the additional formality required for this is to make share transfer by the society office bearer only.

So such transfer by a Registrar is absolutely baseless and unfounded.

Lodge complaint with the registrar.
