A technical resignation should be given and then you can leave your previous organisation and join the other department. Yes your pay and seniority shall be protected.
Pay protection in central government autonomous body
I have applied for a post in level -4 in 7th cpc structure in an autonomous body on direct recruitment through proper channel. I am currently in level-6 in another autonomous body of central government working for past 5 years. my current basic pay is 39900. i want to know whether my pay will be protected if i get selected in level-4?

sir, my curent dept is saying that it is not possble while going to lower post. but only possible when one goes to upper post or the same post. please clarify

Yes it will be protected
no pay protection can be given. Normally pay protection is not given if employee is recruited to lower post from higher post. As per rules an employee can apply for only higher pay scale post.
Pay protection will not be applicable if you join on a lower grade on another organisation.
If you apply for the post under technical resignation, then your pay will be protected besides other privileges that are applicable.
In cases of appointment of a Government servant to another post in
Government on acceptance of technical resignation, the protection of pay is given in
terms of the Ministry of Finance OM No. 3379-E.III (B)/65 dated the 17th June, 1965
read with provisions of FR 22-B.
Thus, if the pay fixed in the new post is less than his pay in the post he holds substantively, he will draw the presumptive pay of the post he holds substantively as defined in FR-9(24). Past service rendered by such a Government servant is taken into account for reckoning of the minimum period for grant of annual increment in the new post/ service/ cadre in Government under the provisions of FR 26 read with Rule 10 of CCS(RP) Rules, 2016. In case the Government servant re-joins his earlier posts, he will be entitled to increments for the period of his absence from the post.

I must point out that when joining a lower grade, technical resignation is not allowed. Therefore you cannot enjoy the perks of a higher grade pay on a lower post.
If any person apply for lower post then there is no provisions to protect the pay.
