• Plying of BS 4 vehicles in NCR

Sir,
 There is a rule that "No vehicle should pick up or set down goods between two points situated within NCR unless the vehicles confirm to Bharat stage 4 norms". This statement is stamped on every vehicle permit by the Registering Authority of NCR. 
 It is requested to kindly provide the exact Rule, Act or section of the act ,court /NGT ruling which specifically states the above mentioned statement which can be accessed by me online for further necessary action.

A three judge bench of SC made it clear that only BS VI compliant vehicle shall be sold in the country from April 1st, 2020. This is SC judgment delivered on Oct, 2018.

 

AND Rule 90(7) of Central Motor Vehicle rule 1989 - the vehicle shall not pick up or set down goods between two points situated in the same state (other than the home state).

- This statement is as per Rule 90 clause 7 of the Central Motors Vehicle rule, and you can get the said Act/rule from website as well.

- In a recent ruling, the Supreme Court has ruled that BS4 vehicles will not be sold after March of 2020 when the BS6 norms are put in place.

- The BS (Bharat Stage) norms are based on EURO (European) emissions standards.

- Government of India In 2016 , decided to skip BS5 altogether and implement BS 6 by the year 2020.

New motor vehicles conforming to Emission Standard Bharat Stage-IV, manufactured before April 1, 2020 shall not be registered after June 30, 2020.

It said amendment in the rules will be done in exercise of the powers conferred by section 110 of the Motor Vehicles Act, 1988.
