• Father's middle name

My wife's father's name is "SUNIL KUMAR MONDAL"
But in her 10th, 12th and graduation documents it is SUNIL MONDAL. Middle name is missing ...
She is in central Govt. service where in her service book her father's name is mentioned as SUNIL MONDAL. She has passport where her father name mentioned as SUNIL MONDAL.
Where as in her all identity documents like birth certificate, aadhar and pan, voter id it is SUNIL KUMAR MONDAL which is the real name of her father.
What should I do?
Should I change her father's name in identity documents without middle name as stated in her educational documents ..
what she should write her father's name in NPR form.
will this create any trouble in upcoming NRC.
will a simple affidavit will work?
In the eye of law SUNIL MONDAL and SUNIL KUMAR MONDAL same person??

If you are si much worried about this minor error,  then an affidavit may be affirmed by her father stating that he is known by both the names and that both the names are one and the same.

The notarized affidavit may be published in a local newspaper for confirmation.

A copy of this affidavit and newspaper may be kept along with the identity proofs of your wife which would solve the problem.

1. She shall have to execute an affidavit before the 1st class Judicial Magistrate affirming that her father is known in both the names viz. Sunil Mondal and Sunil Kumar Mondal and that her father's name has been mentioned as either Sunil Mondal or Sunil Kumar Mondal  in all her documents and in the said circumstances both Sunil Mondal and Sunil Kumar Mondal should  be considered as the same person as her father.

2. With this affidavit, she will regularise the slips made by her in mentioning her father's full name in some of her documents.

3. However, she can get her educational certificate corrected by entering the full name of her father and  in that case there will a change in the affidavit as while applying for passport her school leaving certificate will be required.

The suffixes Kumar, Prasad, Das, Bhai, Mohd., Singh, Sinh, Dev, Kaur, Kumari, etc. are not as such considered while approving names in Official Gazette. Please note the School leaving certificate of 10th and 12th can be created duplicate by placing an application for change of father's name there on basis of other official documents of your wife where "Sunil Kumar Mondal" is written. Try out the same. If not possible then only go through the entire process as mentioned below.  so far as passport is concerned you may place amendment of name application which can be done online through official website of Passport authority of India.

If none of the proposition as mentioned above works with you and still you want to do something to bring congruence in all the documents, then get an affidavit from her father stating that name " Sunil Mondal" and "Sunil Kumar Mondal" both belongs to him and wherever these names are used, the same belong to him. Get the same attested in Notary Public.

You can thereafter, annex this affidavit along with documents that you produce having two different names of Father of your wife and give one line clarification that as some of the documents disclose distinct name of Father, you have attached an affidavit to support common identity of her father with the form.

If her father isn't alive then she has to make an affidavit stating that the documents where "Sunil Mondal" is written and the documents where "Sunil Kumar Mondal" is written both belongs to her.

- As law she cannot change or correct her fathers name in her academic certificates , after two years from the date of passing the same.

- However, she can correct in all her residential and identity proofs after publishing notification in official gazette or an affidavit that both the names are same and of one person only.

Affidavit before first class magistrate is best

2) use Sunil Mondal

3) passport can be corrected based on aadhar card and school leaving certificate

1. Notarised affidavit will be sufficient.

2. She can use the same name whatever appears in her documents, because the affidavit for name change is to be affirmed by her father and not her.

3. She may to apply for re-issue of passport for the said reasons.

1. In your case you shall have to execute the affidavit before the 1st class judicial Magistrate.

2. You shall have to decide on this issue and mention the same in the Affidavit.

3. Yes, the affidavit affirmed before the 1st class judicial Magistrate should have a tactful mention in this regard.
