Sir We are a private limited company and we are purchasing 100 acres of land from different owners of a village near Bangalore for our buisness needs. The nature of land is agricultural having various survey nos. Registered Agreement to Sell and Registered GPA have been executed with various owners of the properties. We have applied for conversion of the land use (CLU) with the concerned registered authorities. We have also checked all the RTC, Mutation Records, ILRR etc and have confirmed that the persons with whom we have executed registered Agreement to Sale are the real owners and have obtained CLU Certificate from the Government. Main Issue which we are facing now is that few Survey Nos are Inam Lands. Can we execute a registered Sale Deed for such inam lands? Can the Dy. Commissioner take back the inam land after the sale deed is registered and executed in favour of our company? What are ramifications and implications of purchase of inam lands in Karnataka? What are the legal remedies available if after executing a registered sale deed and GPA of such inam land Government issues an order to return the land under KLR Act, Karnataka Inam Act etc

1. INAM lands CANNOT be sold /purchased by ANYBODY, without first converting the inam land into "free hold" land by conducting due procedure of law, thru the office of the district collector.
2. Anything adverse to the above, the collector is empowered to confiscate the inam land, without any compensation, without any further references and possibly initiating prosecution for buying inam lands.

After independence, the erstwhile Mysore government abolished the law under Mysore (Personal and Miscellaneous) Inams Abolition Act, 1951, which came into effect from February 1, 1959. As per the rule, those who were allotted inam land should seek permission of the special deputy commissioner for sale.
Since the Inam land is allotted for occupancy or ten ency rights only, the inamdar cannot alienate the proeprty by sale without the permission of the Commissioner of the land revenue.
If this violated then the sale be rendered as invalid if it is brought to the notice of the competent authority/revenue department
