• Inter seniority between. Direct recruit and promotee Asstt. Engineer in C G pwd

Who will be the senior between DRs. And DPCs Asstt Engineer recruited in year 2008 in cg pwd . The CG psc recommended DRs on 13/02/2008 but recruitment order were issued on o2/08/2008 by cg pwd and for DPCs were took place on 24/07/2008 and order were issued on 31/07/2008.
 Note... The demand letter for DRs were sent to cg psc on 27/09/2004 by cg pwd

Seniority became dependent upon the date of initiation of the recruitment process, and not on the date of actual appointment.

The DPCs were promoted well before the direct recruitment candidates were inducted. 

Therefore the date of assuming the charge in that particular cadre shall be counted for seniority.

In my opinion you may not be entertained by supreme court directly before exhausting the remedy in the CAT or high court.

Did you confirm your position when compared to the DPC especially with regard to the date of actual recruitment to that of their date of promotion.

If you feel aggrieved by the decision of the department to not to entertain your claim and if you feel justified as per the ruling cited by you and are confident that this should be rule you can very well knock the doors of court seeking justice as suggested.

It is not necessary that the lawyers opinion should always agree to each other, it depends on the interpretation of law involved ion the subject matter.
