• School built in commercial converted land

I have built a school in a commercially converted land of 3 acres but the problem is in my conversion they hav stated Commercial( amusement park) which was done at the time of conversion. But later we built a school. Now i have applied for conversion for change of land use Commercial ( educational) . My work is getting delayed. Is it not possible to convert as both falls under same commercial category. I have paid commercial conversion fees also

Conversion order mentions it is for amusement park 

 

2) you have built school and not amusement park 

 

3) you need orders for use of premises for educational purposes

File a RTI application to know the status of your application . Since already the property is converted to commercial and the fee is paid the order can be passed and the use can be rectified to educational.

Dear Client,

Conversion from GREEN BELT is restricted but under The Karnataka Land Reforms Act permits in certain cases, special permission to be given by the Deputy Commissioner, for purposes like schools, hospitals, libraries, sports clubs, cultural buildings, exhibition centres, low income housing, temples, etc. When this permission is applied for, an N.O.C. from the B.D.A. is required. 

Here issue is minor - already commercial - all required is amusement to educational - no prior permission -  penalty will be paid. Until application not rejected, no issue, in case rejected can file appeal against the order. Fair chances of success.

As per Karnataka Munipalities model bye laws 2017 and educational building is defined as:

‘Educational Building’- Includes a building exclusively used for a school or college,
recognized by the appropriate Board or University, or any other Competent Authority
involving assembly for instruction, education or recreation incidental to educational use,
and including a building for such other uses as research institution. It shall also include
quarters for essential staff required to reside in the premises, and building used as a hostel
captive to an educational institution whether situated in its campus or outside.

Have you folowed the norms for this including approaval of the plan and also the regularisation formality.
