• I want to purchase Agricultural property

My father has sold his Agricultural property 10 years back and don't have any Agricultural property.Now I want to purchase Agricultural property in my name .if I get 1) Family tree from village Accountant AND 2)Agricultural Family certificate from Tahsildar.
Is it possible for me to purchase Agricultural property without DC permission and without DC Agricultural Family certificate

See since there is no agriculture land in your name or father's name now you will not be treated as agriculturist as under Karnataka law only a person involved in agriculture activity by himself or family is agriculturist. So you will need the DC permission under section 79 to purchase land.

Further if you can get certificates of an agriculturist you can buy without permission but in my view there are bleak chances of same.

  1. As per the information mentioned in the present query, make it clear that you had the family background of farming, but now not been practising the same since long.
  2. As per the settled law, a person from a farmer family may buy agricultural land for the same purpose only.
  3. But, here you have not been doing it since long, so I advice you to please make an application to the DM for considering your case, see his response and then go accordingly.
  4. Though there are rulings by the apex court to not to see the time gap for a person from a family of farmer.

Please see sections 79 to 82 of Karnataka Land Reforms Act wherein Asst. Commissioner is authorised to issue

such permission on the reports of the Tahasildar etc.

This rule is only in karnataka and maharastra as per my knowledge, each every state having different rule and regulations

For buying agricultural land inn karnatka agriculturist certificate is compulsory non agriculturist can't buy agri land in karnatka

it's obtain from collector office by showing your agri land owning  record

Collect record from land  revenue department and you can discuss with them about all these required certificates and from where you get,they can help you better

Also discuss with them about your eligibility as a agriculturist please consult local lawyer before moving forwrd

Since you belong to the family of agriculturist, you are eligible for buying agricultural land.

In fact it is not essential to belong to an agricultural family in Karnataka for income up to Rs. 25 Lakhs to purchase agriculutral land.
