• Intimation to current employer regarding app filled for other govt jobs before joining current job

Sir,

The sequence of events are as follows-

> I had applied for a Central Govt. job (Job 'A') on 23/07/2017. 
> I joined a CPSE (Job 'B') on 18/08/2018.
> Merit List for Job 'A' was announced on 31/10/2018.

Now, as per the letter - DoPT OM No.28020/1/2010-Estt.(C) dated 08.04.2016, 
 for getting technical resignation, it has been written in point no.-2 (i) that-
"The Government servant should intimate the details of such applications ---immediately---"

Request you to please clarify-

(a) The meaning of immediately here, that is, till how many months from my joining in Job 'B', I am allowed to intimate to employer of Job 'B' regarding the application of Job 'A' which I have filled prior to my joining in Job 'B'.

(b) Would it be okay if I intimate them on 08/11/2018 regarding my application for Job 'A'?

(c) Am I eligible to get Technical resignation according to the aforementioned DoPT letter, if I follow the step '(b)'?

P.S- The reason why I did not find useful to intimate employer of Job 'B' regarding my application for job 'A' till I got my name in merit list (on 31/10/2018) was that according to the initial educational qualification requirements of job 'B', my degree was ineligible for the job due to which many candidates filed Court cases were filed and which were pending in The High Court, New delhi for a long time. The final judgement in our favor was announced on 04/07/2018.

Hi,

You may intimate the present employer regarding your selection in other better job and ask for technical resignation.

Your case is different what you have stated Immediately or lately , it was not in your hand so whenever you reply or has to be given in writing or now wants to give in writing please quote Judgment of Hon'ble High Court and its date as the reason.

The Government servant at the time of joining at the current service should intimate the details of such application immediately on his joining.

The Government servant at the time of resignation should specifically make a request, indicating that he is resigning to take up another appointment under Government/Government organisation for which he applied before joining the Government service and that his resignation may be treated a ‘technical resignation’ .

The authority accepting the resignation should satisfy itself that had the employee been in service on the date of application for the post mentioned by the employee, his application would have been forwarded through proper channel.

CONTINUITY OF SERVICE ON TECHNICAL RESIGNATION (LIEN)

A permanent Government servant appointed in another Central Government Department/Office has to resign from his parent department unless he wants to revert to that department within a period of 2 years (or 3 years in exceptional cases). Such resignations shall not be deemed to be resignation for the purpose of pension, if admissible. As a consequence, continuity of service benefits should be allowed to such employees in the matter of pension, leave, LTC, etc. as admissible under the rules.

If the resignation from a post under a Central Government Department is technical, the tenure of service already completed by an employee is added to the time period spent while on service in the next post while determining the years of service for age relaxation provided for Central Govt employees.

So it will be your own decision that when you will inform and what benefits would you like to avail and how it would effect if you delay your decision to intimate the authorities about it.
