• A community welfare society registered under Bombay trust act 1950

Our community Sangha named "Bhovi Samaja Seva Sangha (R) Sirsi N.K.was registered on 28/10/1957 under Bombay trust act 1950. It is established as a social sangha for uplift of our community people. On 15/1/1979 and 25/2/86 the sangha was renewed the registration giving details of the then committee members and changes in the sangha constitution before the Charity commissioner, Belgaum. From 1989-90 till 2005-06 there were no activities. In 2006 it was revived and continuing. Sangha purchased an immovable property in 2017 and wants construct a community Hall taking help from Govt. Some advocates suggest to renew the registration before applying to Govt. assistance. Registrars of societies are unwilling to renew and we do not know where the sangha registration files, where and how to proceed in the matter. Kindly guide us

you can submit an application for duplicates, along with an indemnity bond, to your society. The latter is a contract, wherein you promise to make good any loss that may arise in case the original instrument is presented. "Since some people mortgage originals as security with banks and then ask for duplicates, the society may ask you to give an undertaking that you have lost the originals in order to avoid fraud," says Gupta.

The society will then invite objections by affixing a notice to its notice board as well as through a notice in the newspaper. You may be asked to foot the associated costs, and some societies even expect you to assume complete responsibility for this task.

If there are no objections within a stipulated time frame—ranging from 15 days to one month, depending on the society—you will get your duplicate certificates for a fee of Rs 500-1,000.

KARNATAKA SOCIETIES REGISTRATION ACT, 1960

Under this Act the societies for the following purpose may be registered.

Promotion of charity,Education,Science,Literature or fine arts.

Promotion of sports

The instruction and diffusion of knowledge relating to commerce or industry or any other useful knowledge.

Diffusion of political education.

Maintenance of libraries.

Promotion of conservation and proper use of natural resources.

Mode of forming a society.

Any seven or more persons,above the age of 18 years associated for any of the purpose specified above.

Fee.

For Registering a new society in Bangalore Metropolitan Regional Development Authority limits, the fee in is RS.1000/-

In any other area it is Rs.500/-.

50% fee concession for women and SC/ST societies.

Rs.35/- per page scanning fees .

How to apply.

Application for registration is to be submitted to the Jurisdictional District Registrars.

Documents to be submitted.

Information in Form A.

Memorandum of Association and Rules and regulations duly attested by one of the subscribers to the memorandum authorized by proposed society.

List of subscribers to the Memorandum of Association along with photographs and signature

Proceedings of the first meeting to form a society

Challan for having paid the prescribed fee.

Affidavit in the prescribed form in Rs.20/- E-Stamp paper duly notarized

Copy of Address proof and identification proof.(Any one of the following)

1.Adhaar Card .

2.Voters ID

3.Driving License

Address proof of society proposed to be registered.

1.Rental Agreement

2.Tax payment receipt with NOC.

Sir contact the charity commissioner office in the Belgium where the Trust was registered get certified copies of the earlier document such as memorandum and Bye laws after that apply for renewing the certificate further the office the commissioner office shall be in best position to guide you looking at previous record whether to continue with same registration or apply for renewable of same with the changes.

Firslty, it has been very rightly suggested by some of our fellow advocates to get it renewed first then go for government help.

Secondly, if you go before getting it registered then you may have allegation of some fraud in your mind against the state funds.

Thirdly, you need to move an application for getting the records from the registrar’s office plus also moves a RTI simultaneously.

Fourthly, if then deny the records then there is one more way to get all from them.

Sir, if the above aideswquent query is for me then let me answer you again :-

I am trying to say that sometimes you may lost the records, and then it may be required in future.

So, being the authority who gives the sanctity by registering it, has a duty to keep the records with them irrespective of the fact as to how old are they.

In your case also for renewing, they may ask for the previous documents of registration.

That is why I asked tu to go ahead and ask for the certified copy of the same.

There is a legal way of doing everthing which only known to an advocate.

If you wish, I can draft an application plus RTI to grab everthing which we need from them.

Hope, now it is cleared to certain extent.

Dear Client,

By enactment of Karnataka act, Charity commissioner, Belgaum has no jurisdiction to deal with society situated in Karnataka and void at present.Under Karnataka act, society has no existence, so no situation arise like renew, Have to apply for fresh registration.

Please ignore if Courts of Karnataka have different view but rare possibility.

Preamble of B T Act. - It shall extend to the whole of the State of Maharashtra.

Based on the available records of the Sangha, you may submit an application to the registrar for renewal.

Let them deny the renewal and give the reasons in writing, after which you can approach civil court or high court seeking direction to the registrar to renew the license of the trust as per law in vogue.
