• Grand-daughters share in grand-mother's share

I am a senior citizen. I have 2 other alive elder brothers and one deceased elder sister.

My mother had inherited her dad's property. My mother were two sisters(both deceased long long back over 30 years ago) and had no brothers.

There is no will done by either my mother or her father(my grandfather) at any point of time.

My sister died long back almost some 15 years ago. She has a surviving married daughter.

P.S. We are residents of West Bengal and the said property is in West Bengal.

My questions is -

Whether my sister's daughter is legally a share holder of the properties?

Dear Client,

The Dayabhaga school prevails in Bengal which deals with inheritance.

Here both sisters will inherit equal share in father`s property along with brother and deceased sister share will inherit in her Daughter/son.
