• Land deed in Uttarakhand

We have buy a land from sc st into 194-95.but did not do deed at the time cause of some family reason.
Would it be possible to take deed at this time.
Or what we do if they are refusing to sign.

hello,

you bought a land from an SC/ST. you gave the money but did not make registered sale deed. there is no proof that you purchased the land except maybe the cheque/ cash transfer.it is possible to register the property at this time. but if he refuses you cannot do anything except maybe filing a case of cheating and fraud.

moreover, I should inform you that in 1994-95, UK was in UP. so the land laws of UP were applicable. at that time you could not buy a land from an SC/ST if you were a general category. then if you are a general then the sale at that point of time would have been void.

1) As per limitations act, you can't legally force them to sign deed.

2) If by mutual understanding they are able to do aifn and perform sale deed then it's well and good.

You need prior permission from collector to purchase SC /ST land . Seller has to apply to collector

2) obtain prior permission then only sale deed can be executed by seller

If you have paid full sale consideration amount at that time and have evidence for that, then you can approach the seller for getting the registered sale deed executed even at this stage though you may have to pay the stamp duty as per current market rate for registering the proeprty.

If the seller refuses then you may approach court with a suit for specific performance of contract seeking direction to the seller to execute a registered sale deed in your favor.
