• Eligibility of my state quota

I belong to Assam my caste is ST sub-caste MIRI. In 2016 I married and now I Live with my husband in West Bengal. I have a domicile certificate of West Bengal but my caste certificate is of Assam and does not recognized by the West Bengal government. So is my caste certificate valid in West Bengal to avail state quota for competitive exam?

hello,

if the state recognizes your caste then only you can avail the benefits. you are not a domicile of Assam. but still, kindly refer to the notification of domicile residents wherein certain persons who start living at a place come within the domicile of that state, the position would be clear once you get hold of that notification.

Firslty, the caste certificate which you are having will remain valid in all over India.

Secondly, it is only for the OBC which differ from state to state.

Thirdly, you should file a RTI asking government to give an answer as to under which provision they are denying the benefits.

Fourthly, whether they say no or yes, you need to file a Writ of Mandamus in the High Court for direction to give all benefit if their answer is no or if yes then ask in the Writ to amend their law as others state compliance only with the centre list with regard to the same.

Dear Client,

If your caste is not included in reserved caste state list of WB, than NO.

Different state have a different list of tribes and caste included in their list and only these categories or castes or tribes can avail the benefits provided by reservation.

But such benefits available for such exams/jobs which are conducted by UPSC and governed by central act.

The community certificate given by a state government authority is very much valid.

But if your community do not come under the list of SC community in West bengal then you may not be able to avail concessions for SC community in West bengal state government, but you will become eligible for the Central government jobs.

You cannot get domicile certificate from two states

If your community is not covered under the list of ST category in WB, then you cannot claim the concession provided

When there is no provision in law there is no question of how you can make yourself eligible for reservation.

You may look for Central government opportunities.

hello,

the state quota would be given to you if that particular caste is being provided reservation in that state. if the state of WB does not reserve seats for your caste, a person cannot take benefits of the reservation in state services or educational institutions.

Domicile will acquired after 10 years continuous stay but what the use until , your tribe is not is WB state ST list.
