• Leave policy and related guidelines in a PSU bank.

Dear Sir ,

I have been selected as an officer in a PSU bank. I will be on a probationary period of 2years. Also at the time of joining, I will be 2 months pregnant. I want to know the following questions- 

1. Can I take paid maternity leave say 3-4 months after joining the bank? If yes, what are the conditions?
2. If I am allowed to take maternity leave during probation period, can I couple it along with child care leave too ? The bank does have a child care leave policy for women employee but it is not clear whether the same is paid and allowed during probation period.
3. Will my probation period be extended because of taking maternity leave?
4. My husband is also a central government employee. Is there any guideline or law which states that if both husband and wife are government employees, they are eligible to be posted together in the same location??

Pls answer my queries.My decision to join the bank will be entirely based on this.

1) you can avail maternity leave 4 months after joining bank

2)Pregnancy: 180 days – Admissible only to employees with less than two surviving children.

3)The maternity leave is not debited to leave account and full pay is granted. It cannot be combined with any other leaves and counts as service for increments and pension.

4)Paternity Leave :- A male employee with less than two surviving children may be granted Paternity Leave for a period of 15 days during the confinement of his wife. During the period of such leave he shall be paid leave salary equal to the pay drawn immediately before proceeding on leave. Paternity Leave shall not be debited against the leave account and may be combined with other kind of leave as in the case of Maternity Leave.

5)Child Care Leave :- Woman employees having minor children may be granted Child Care Leave by an authority competent to grant leave for a maximum period of 730 days (2 years) during their entire service for taking care of up to two children., whether for rearing or to look after any of their needs like examination, sickness, etc..

Conditions for Child Care Leave

1. Child care leave shall not be admissible if the child is eighteen years of age or older equal to the pay drawn immediately before proceeding on leave.

2. It can be availed in more than one spell.

3. It can not be debited against the leave account.

4. It may be combined with leave of the kind due and admissible.

1. the MB Act has been recently amended as a result of which the duration of leave ahs been increased from 12 weeks to 26 weeks.

2. It can be divided into two parts, beofre and after delivery of child.

3. Work from home option can also be availed if the nature of work so permits.

4. If both the couple are government employee then they can opt for transfer in one place .it is permissible if there is such vacancy.

1. You said that you are selected for the PSU bank job and are yet to develop the family, why dont yo postpone the expansion of your family till such time that you become eligible for maternity leave.

Women on probation can apply for maternity leave if she meets following conditions.

Every woman employee, whether employed directly or through a contractor, who has actually worked in the establishment for a period of at least 80 days during the 12 months immediately preceding the date of her expected delivery, is entitled to receive maternity benefit.

2. What is child care leave, if this is an unknown thing to yor organisation, o may not be eligible for availing such concessions, you should ensure the benefits that are available under the latest maternity benefits act 2017 alone.

3. If you are eligible for maternity leave then the probation period may not be extended.

4. Spousal posting policy is prevalent in almost ll the organisations. You may refer to the rules of your bank .

If you are yet to join the bank, decide not to get pregnant for at least three months after joining the employment.
