• Can a developer stop payment of rent for alternate accommodation

Dear Sirs

I am 64 year old widow. The developer agreed to pay me the rent for the alternate accommodation in lieu of my Room in the building which is now demolished and the construction work is in Progress. For first two years he paid the monthly rent. From August 2015 he has stopped paying the rent - telling me that he has fund crisis - however the work of the Building is going on at a good pace in the center of Mumbai. 

For one reason or the other he is dodging to pay the agreed money

What is the course uunder law I have to file the complaint - which will compel him to make the payment of the rent immediately

2) seek orders to direct builder to pay you monthly rent as agreed upon

1.File an injunction in the court of law seeking stay of construction of the building.

2.However before doing so you can send legal notice.

3.there msut a penal clause of default of terms of development by the developer.

4. So you can reoly on that terms of the conditions and seek necessary relief from court.

5.once you manages to stay the constructions work though court of law you would soon see the result.

You have to issue a legal notice to him demanding the rent for the period from which he stopped paying the same.

If he is still not responding then you my file a injunction suit restraining him from progressing with the construction until he pays the entire rental amount as on date.
