• Excessive mental pressure and threatening to degrade in appraisal

Dear Sir/ Madam,

My wife of very straight forward and undiplomatic nature is working in a PSU wherein official work timings are till 3:30 PM. She along with her colleagues are continually pressurized by reporting officers to stay back late to finish whatsoever task they are presented with in record times which are humanely or technically not possible. It seems my wife being outspoken is especially targeted to do so. At times the matter has lead to verbal threatening of reflecting the same in the Annual Performance Appraisal.
Few superiors are constantly repeating the similar verbal quotes daily putting a huge mental burden and affecting our normal and personal life. Office related stress has taken a bad toll on the physical as well as mental health.

I would like to know that are there an legal ways by which one can tackle these menace?

1)on account of work pressure these days employees are required to work even after official work timings

2)you cannot refuse to stay later as in annual appraisal you would get poor ratings

3)it is not that only your wife is pressurised . her colleagues are also told to stay back and complete the work

4) your wife should take a transfer

1) If your wife has been verbally abused by her seniors by using foul language she can certainly file complaint with the higher authorities

2) Sexual harassment includes

Implied or explicit threat about her present or future employment status

Interferes with work or creates an intimidating/hostile/offensive work environment

Humiliating treatment likely to affect her health and safety.

3) Committee will have to be set up to inquire into her allegations and resort submitted within period of 90 days

1.Well,there must a grievance redressal mechanism in the bank.

2.If that is so then your wife files case of complaint against her superiors.

3.If there is Service Rules which mentions the work timings then your wife can take shelter under it.

4. however 1=2 hours extra work on asking of her superiors may not be redressed if she lodges complaint against them.

Your wife being a permanent staff can raise her voice or concern on this unreasonable demand and pressure from her superiors and can intimate them that they cannot torture her or demand her to work beyond working hours and also can warn them against their threats to give adverse remarks in the annual appraisal report.

She can take up the matter with the staff union for remedy and relief agaisnt the torturous officers.

She can even make a representation to the top management about this and seek their intervention if the tortures are beyond tolerance level.

But there shall be a limit to what the superiors expect from one sub-ordinate. Continually asking for more work can lead to a miserable life disturbing the social balance which shall be more counterproductive. Is it feasible to charge a superior for using foul or unprofessional language at workplace?

She can use the provisions of law against the harassment to working women at work place and sexual tortures.

She can record their foul mouth abuses and can take up the matter to top management stating that these are derogatory and outraging the modesty of women.

For the extra burden of work, she can remain in her seat upto the close or working hours, after which she can abruptly close her table and leave the place, she need not be frightened or scared about their remarks, this matter can be taken up through labor court also.
