While doing survey our building corner came on another guys survey number and our 3.5 cent land is with him. Do we have any problem with building if he file a case against us. Kindly reply back.
How we can defend against him to protect our building.He is having our 3.5 cent. Is there any chance to make it as an exchange of the property.
1)neighbour can file suit to demolish illegal construction made on his property
2) reach an out of court settlement with the neighbour
3)deed of exchange can be executed wherein your 3.5 cents is given to him and he gives you portion of land on which building is constructed
deed of exchange can be executed duly stamped and regsitered
You have to ascertain your area of extent as well as your boundaries with the neighbor before starting the construction work and settle all the issue or else he may try to obtain stay of your construction and then you will be spending time on litigation only instead of construction.

You can ask him to buy that portion of the property now he is illegally occupying or else you can file a suit to re-possess your property by filing a declaration and possession suit.
