• Two names for a single person - not able to transfer property

We have a unique problem w.r.t the name of my father in records.

My father has got two names! His original name is Krishna Reddy Muddam s/o Malla reddy Muddam, (my name is Sateesh Reddy Muddam S/o Krishna Reddy Muddam in all my official records) and he was a farmer until he got a job in a PSU as a workmen 35 years back. For the last thrity five years he is working in PSU with a name Krishna Reddy Pallela S/o Venkat Reddy Pallela. Please note that the surname and father name changed, in the records of PSU. The reason for this is he is uneducated and while joining the job he is unaware of the mistake in the records and later on he didn't bother to correct in the records. 

He has bank account , PAN Card, Adharcard in the name, Krishna Reddy Pallela S/o Venkat Reddy Pallela. 

He is holding PAN card and voter ID in both names. HE Don't have bank account in original name. He took PAN and voter card in original name only for the purpose of ID card for property purchase.

In last 10 years he purchased one agriculture land and built one house both of which are in his original name I,e Krishna Reddy Muddam s/o Malla reddy Muddam. One ancestral property (Agricultural land) was already transferred into my name as gift deed few days back. 

Now Telangana government has made ADHAR linking along with fingerprint scanning to verify the details compulsory while doing any transfer at the registration offices. Now that he don't have ADHAR card in original name, and ADHAR card is in different name than that of the property records, he is not able to transfer the land nor gift to me.

He is getting retired from PSU this month end and he ll receive pension , hence he has to continue the name in PSU records. Two properties are still in his original name for which ADHAR card is not available.

Please suggest the way out!!

your father should change his name from Krishna Reddy Muddam to Krishna Reddy Pallela by gazette notification and publication in 2 local newspapers

since he has Aadhar card in the new name your father can execute gift deed in your name have it duly stamped and registered

3) in the alternative father can execute will bequeathing properties to you . apply for mutation of properties in your name on father demise

The difference in name is not accidental but intentional.

He is not only having a different title but also different name of his father.

His father name differs from each other.

There is no confusion in this, it is very clear that both are two different names.

He cannot even apply for change of name because his father's name is obviously different.

If at all he has to do the things legally and set the things right, he may file a declaratory suit seeking to declare his correct name by which he wishes to be known in future by producing substantial evidences supporting his pleading

1. Yes it will certainly create problem because his father's name itself differs to each other.

2. Legally it is not valid and not a right action.

3. You may consult a local advocate and file a declaration suit to declare the correct name of your father as per the documentary evidences supporting your pleadings
