Dear Sir my name is Sudhanshu shah and i booked 2bhk flat in GTM forest lavana project Dehradun on 20th match 2014 (on lottery GTM flats)but contruction work speed is pathetic in 2 bhk flats and becoz i needed a quick possesion of flat i met indira and capt Vasisth who are representative Of GTM and told my concern they told me that my flat no 506 will be ready for possesion at the end 2016 and but if we wanted to move soon in GTM we can apply for flats which are in the end of completion(i.e last two towers of block A of GTM lawana project )they also they showed us flat no A-531 and A-527 and they assured us that these flat will be ready for possesion on dec 2015 or in around feb 2016 after that we shortlisted A 527 they assure me they can give me possesion of these flats in december 2015 or in feb 2016 ,becoz of this i wrote a application for shifting my flat A-506 to A-527 and emailed my application(12/07/2015 10:49 pm (GMT+05:30) and i clearly mention in my application "that i am shifting my flat only becoz GTM representative assuring me that they will give possesion of flat in december 2015 or in jan of 2016 and i also paid 3rd ,4th and 5th installment (85% of total cost) now the main problem when i visited on site const is stopped when I contacted customer care of GTM project about this they said as per buyer seller agreement “Buyer Seller Agreement executed between us on 26th July 2015.Please refer Page No 11 (Point 41) for your reference Which confirms “That the possession of the said Flat is likely to be delivered by the company to Allotee(s) by 36 months from the date of allotment” but my first buyer seller agreement of flat no 506 is executed on 26 july 2014 and becoz of false promises of builder I shifted to from A-506 to A-527 and signed new buyer seller agreement on 26 july 2015 ( I hv both agreements copy and allotment letter ) and now builder keep delaying possession its july 2017 and still builders need more 3,4 month for giving possession , Please help me in this case

You should have read the terms of agreement before signing
2) as per terms of agreement possession can be delivered by July 2018
3) since you have waited so long better wait for 3 months andtake possession of flat
4) you would not get compensation because as per agreement signed in July 2015 possession is to be delivered in 36months
Don't file complaint before consumer forum
You would be wasting you r time and money on legal fees
If the delay is inordinate and the builder is not responding properly you may first issue a legal notice demanding the present status and also penalty or interest towards the period of delay
Failing to get any response or compliance you may aproach consumer forum for deficiency of service and also for compensation or can even approach RERA for relief and remedy.

You can file a complaint before the consumer forum as a party in person,
You can take advise about filing from local advocate
Whether the case is strong or weak will depend on how you strong you make your pleadings and put forth your arguments before court.
