• Leave and licence agreement

I have give my house on leave and licence basis for a period of 11 months.the 11 months period expired on 12/6/17. The tenants without giving one month notice vacated my house and refuses to pay rent and electricity bill. They have not my maintained my house properly. The cleanliness is in worst condition. I have to make repairs like plumbing work and other Misc works.I have not notarised my agreement on mutual trust. Can i give notice to them by Registered post as i have all their address proof and identity proof. what sort of action i should take. please advice me

1) issue notice to licencee to pay outstanding electricity, rent, also pay for damage to plumbing work etc

2) if he refuses to pay file suit for damages to claim the loss suffered by you

The tenant need not give notice to vacate the premises if the l&L agreement period has expired.

However he is liable to pay for damages and repairs and painting.

You may issue a legal notice and demand the cost for compensation.

Dis you keep aside any lump sum as security amount which is generally refundable three months ent.

If yes you can deduct the as said sum towards arrears amount and the repairing works.

If not then you will have to file recovery suit for money which is though advisable keeping not the huge sum of money at stake in mind.
