• Legal liability of daughters towards irresponsible 65 year old father

We our are 3 daughters, elder- divorce, myself - staying with in law & younger - unmarried all of us are graduates and working and they both of them are staying with our mother who is a heart patient. All our educational and even house expenses (provision, rent, clothing) we bared by our maternal uncle's from our schooling days. In the name of business loss(beating for horse race) pledged all valuables and obtained many debt. After our edu we have paid many of his debts. Always blackmailed my uncle's will away from home or commit suicide and leave a note on ur sis. Now he is in medical care centre as he lost is leg due to diabetic foot, all his operations (2lakh) and staying (20000+ additional/month) expenses are all Taken care by us. Though he his got ancestral property. Now he is again blackmailing us if we don't take him immediately to new house (rented) as per his requirement and keep a healthcare assistant at Home he will commit suicide and leave a note on us. As he is got ancestral property out of which he can take care of his expenses, should we bare his expenses. Can we send him any notice so that he stays away from us- stay at medical centre( where we ll pay expenses) or at his ancestral property but not where we are staying. Once he had already ran away from house (actually stayed at his parents house) with note- please pay all my debts (lists) only then I ll be back. We have our personal loan taken for marriage and my education loan which when released only half of the amount he only withdrew Rs 45000 in 2001 and I had to ask my uncle's again for paying fee....

Don't bow down to uncle blackmail tactics

2) tell him to stay in medical centre or at his ancestral home

3)tell uncle he is free to end his life if he so desires

4) mention that you have already spent lot of money on his treatment and other expenses and cannot pay further

1) Under provisions of senior citizen act father can approach senior citizen tribunal and seek maintenance

2) Court can award him sum of Rs 10000 as maintenance from his working daughters

3) you can issue him legal notice not to harass you an d your sisters . Offer to transfer Rs 10000 to his account every month

If your father is unemployed with no income to sustain his day to day expenses then he may claim maintenance from his educated and employed daughters also.

However he cannot demand separate house or insist on living with the daughters

The offer by the daughters to provide him with separate accommodation and reasonable money for his monthly maintenance will be more than a court order on this.

The threats posed by for suicide etc can be highlighted by the daughters before court and can even term it as a blackmail effort for extorting money from them.

There is no issue in sending him a legal notice instructing him to not to interfere in your lives anymore

You can also restrain him from entering into your house and can warn him that he will be termed as trespasser if he still does the act.

First of all you should lodge a criminal complaint agaisnt him for his acts of threats against you people.
