• Property sale - Khata

Hi Sir, I am looking to sell my property next month on July 20th. I have already got into an agreement with a buyer for a consideration value and the registration in the buyer name should happen next month on July 20th.

I have not got the khata certificate from BBMP yet as my builder had not paid betterment charges till Jan 2017 post which the Khata is getting issued to residents. I have been paying property tax regularly till FY 2018 and have also paid the khata transfer charges to BBMP. 

Though i have started the process now for doing the transfer , i believe i will have less time on my hands to complete the process before the registration date which is on 21st July (3 .5 weeks). Do suggest if i can go ahead and sell the property since i have paid the taxes & charges for khata till date?

have you disclosed the facts to purchaser?

2) inform the purchaser that you have paid the khata transfer charges to BBMP but khata certificate has not yet been issued by BBMP

3) if the purchaser is willing then execute sale deed in name of the purchaser

4) in the event purchaser is not willing cancel the deal

It depends on the buyer to accept the execution of registered sale deed without khatha of the property or not.

If he is insisting the khatha on your name then you may have to produce the same and if you fail to do so, he may initiate legal action.

You may talk to the buyer about this and assure that you will procure the same at the earliest possible post registration of the sale deed.

You can follow it up with the builder vigorously after that.
