• How to get income detail of husband who gets salary from overseas

I have filed dvp case against my husband after many years of marriage. he gets his salary from overseas. How can i get his income details as his company is not present in India.

1)if your husband does not comply with court orders adverse inference can be drawn against him by court

1.Ask your husband to produce the income proof.

2.If he does not produce the same and you prove his employment with overseas company then withholding his income would have adverse effect and the court may consider the income as quoted by you.

3.Unemployment is no excuse and the court would consider his last known income to be his present income.So nothing to worry on this count.

There is no law to force the company to furnish the details of his salary to you as an individual.

You can summon the company through court order to furnish the same before court by petitioning court with details of the employee and the company.

What if he does not do it. He says he is not employed anymore.

You cannot do anything legally if he denies to be employed anymore.

You may have to depend on your own reliable sources to procure the information, the court cannot support you on this.
