• Passport issue

I am 36 year old Jain Hindu male I made passport 10 years back in Udaipur Rajastan when i was in collage it was my first ID document and I changed my date of birth from original year 1982 to fake date of 1983 on documents while submission. I received passport saying my DOB 1983.

I consulted some passport agent few years back for change of date in passport he suggested to make new passport instead of changing date. He created new address and supporting documents of Allahabad address. New passport arrived after few months but i didn't accept and it was returned to mumbai passport office.

I recently went to Jaipur office for renewal of my passport and put application for change in date of birth and there they told me i hold two passport and they will commence inquiry. Udaipur Police gave investigation report already.
I have no criminal record and also i have never used my second passport which i never accepted.
I have small imitation jewellery manufacturing workshop and i export worldwide. 

Will i get penalty or imprisonment is it bailable?
will i ever get passport again?
will i be able to travel abroad for work?

1) Rule“13. Of passport Rules

Issue of additional passport or travel document in special circumstances.- A person holding a passport or travel document shall not be entitled to another passport or travel document unless he surrenders to the passport authority the passport or travel document already held by him:

Provided that separate passports or travel documents may be issued to the same person in respect of different countries if it is necessary so to do for facilitating his visits to such countries.”

Contravening the above Rule is an offence under Section 12(3) of the Passport Act and is punishable with imprisonment for a term which may extend to three months or with fine which may extend to five hundred rupees or with both.

2)In case false information is furnished or material information is suppressed knowingly while making an application for passport, then it is an offence punishable under Section 12(1)(b) of the Passport Act. It is laid down that it shall be punishable with imprisonment for a term which may extend to two years or with fine which may extend to five thousand rupees or with both.

3) you would not be able to travel abroad for work purposes

Imposition of penalties for suppression of information under Section 12(1) (B) of Passport Act, 1967 for:

If the previous passport has expired and the information is not given. the fine amount shall be Rs. 2,000/-

In case, there is forgery of the stamp of ECNR/PCC or any other observation in the passport, then applicant may be interviewed and in case some agent has done this then his name and address should be taken in writing. The forged endorsement should be cancelled and passport restored to the applicant: then the fine amount shall be 5000/-

Under Section 12 of the Passport Act, 1967 – whoever contravenes the provisions of the Act by traveling without a valid passport, knowingly furnishes wrong information or attempts to alter entries made on the passports or travel documents, fails to produce his/her passport for inspection, knowing uses a passport or travel document issued to another person or knowingly allows another person to use a passport or travel document issued to him shall be punishable with imprisonment for a term up to 2 years or with fine up to Rs. 5,000/- or with both.
