• Goa family law applicable to people born or living in Goa

Hello

I want to know whether Goa Family Law is applicable to only humans born in Goa or it is also applicable to humans living in Goa for more than 5 years ?

Does having a Goa Domicile Certificate sorts this ?

If I (Male) am living in Goa for more than 5 years and have property in Goa, does Goa Family Law Applies to me or Hindu Marriage Act Applies to me ?

1) The Goan Civil Code governs the law relating to marriages, succession, and so on in Goa and is only applicable to citizens of Goa. Goan citizenship as per the Civil Code, is acquired either by birth in Goa, or by virtue of one’s father or grandfather being born in Goa. It can also be acquired by virtue of marriage, in the case of a woman, or by naturalization.

2) you would be governed by provisions of HMA

The Goan law shall be applicable only to those people who are born in Goa and not for the people who have been residing there five years or more

Domicile certificate also may not sole this issue.

In my opinion the Hindu marriage at may be applicable to your case.
