• Special marriage act - Document required for U.K. Citizen

Hi , My financee is from England and we plan on getting married in India . We know that certificate of impediment is no longer issued by the UK for common wealth countries (a copy of the letter stating the same is with us ) and we have other documents in place - birth certificate and valid passport. Our only confusion is on the document stated the single status of both the parties . Does my financee have to get one from there itself or must be get one together in India?

1. For a single status no certificate is required to be obtained from any public authority. A declaration the marriage registration form is enough.

2. The physical presence of your fiance is required at the time of submission of form on expiry of one month from the ddate of application.

You’ll need to submit in addition, evidence of eligibility to be married is usually required. Anyone who hasn’t been married should obtain a single status affidavit (in the US), a Certificate of No Impediment (in the UK), or Certificate of No Record (in Australia).

For the purpose of registration of marriage with a foreigner in India, the above said requirement is mandatory.

She can either get single status certificate, but whatever , she has to procure the same from that country only .

There are plenty of solicitors/notary publics in the foreign countries doing the job for the sake of money like their counter parts in India, hence your solicitor's advise that besides apostille, the certificate may attested by the officials of Indian Embassy too, which would render more authentication to the 'no impediment certificate'.
