• Regarding OBC certificate

Dear Sir, 
 I am a resident of Karnataka. My father was a Group C officer for about 20 years and now he got promoted as a Groub B officer at the age of 50 with a salary below 6 lakhs. But in Tashildar office thay are declining my application to get 3A caste cum income certificate saying that my father was a Group B officer. Please clarify whether I am eligible for 3A certificate.

As per the Central creamy layer criterion II & III dated 08.09.1993 only the sons and daughter of following “government servants” will be treated as creamy-layer.

(i) Parents, either of whom is a Group-A officer. (Direct Recruitment)

(ii) Parents, both of whom are Group-B officers. (Direct Recruitment)

(iii) Parents of whom only the father is a Group-B officer and he gets into Group-A at the age of 40 or earlier.

2) in your case you would fall under OBC NCL as your father at age of 40 was not group A employee

3) for government employees only their position in the office is the criterion for non-creamy layer status. Excluding all Class I employees and direct recruits of Class II cadre, all other govt. servants having income greater than 6 lakhs are still eligible for the OBC non creamy layer certificates

As per information available online you would not eligible for OBC reservation in Karnataka GO dated 30th march 2002 SWD 225 BDA 2000

2) the reasons it says candidate would not be eligible if the candidate and either of his parents/ guardian are group A or group B officers or holds equivalent post in PSU

Your father was not promoted in the age of 40 years or less hence he is very much eligible for OBC NCL,

The tahsildar is wrong, ask him to produce the relevant rules and you can educate him, if he still refuses then you may approach the district collector's office for relief and remedy.

Thanks for the reply Sir, my question is particularly related to karnataka state. I wanted to take 3A certificate (OBC in karnataka, Reddy caste, ) for government jobs in karnataka. I couldn't find eligibility criteria for OBC online for karnataka. Please help me with this with some source

If your caste is coming under the list of OBC then the tahsildar cannot refuse to issue the community certificate as per law.
