• Recovery claim for rent against registered rent lease deed

We had taken a shop on three year registered lease deed.
After four month we intimate to the owner that we are not interested to keep continue his shop. handover the key of the same to his third person and assumed that our three month security amount which was deposited with the owner, would be paid for our notice of 3 months and we are free from rent now.

Up to one year the owner remained silent and we also forget it. Now after one year he came and demanded for the amount of one year rent. He is threatening to file a case for rent recovery. What is the chances of case to be decided in our favour or against us.

1) do you have any acknowledgment in writing from landlord regarding receipt of keys

2) did you intimate landlord in writing that you dont want to continue ?

3) in case landlord has threatened you for filing case for recovery of rent send reply in writing that premises were vacated 9 months back and keys handed over to landlord

4) enclose copy of letter of termination of leave and licence agreement sent by you

Have you communicated your intention to terminate the lease agreement as per the condition's of the lease agreement?

Have you issued notice mentioning that you are terminating the lease agreement for the aid reasons?

Have you delivered vacant possession of the leased premises properly while vacating and have informed the landlord that your rent balance if any to be adjusted in the security deposit.
