• Can I file a case of defamation and mental harassment?

Hi,
A woman is suspicious of me having an affair with her husband who is a friend. I am single. In her suspicion and insecurity she wrote a mail to my boss and marked 3 people of my office in CC accusing me of "Poor Professional Conduct" and "Inappropriate behavioral tendencies". After that she has sent 3-4 emails asking me about details of my meeting with her husband and phone calls and messages that I have sent to her. In all her communications she has marked my boss in CC. This has been going on since past 3 days. I warned her that I will file a case against her and file an e-FIR. I have the entire mail trail. I told her that if she sends an apology letter to my boss and CCs my office colleagues I will not do so. But she has not done so. Can you please advise me what would be best course of action? I am also worried that she might reach out to other people and my parents and create more trouble for me. Please advise the next steps ASAP.

1) file complaint of criminal defamation against lady under section 500 of IPC

2) also file suit for damages against the lady and claim compensation form her for maligning your reputation

4) if no reply is received to legal notice then proceed for filing FIR

In the given situation you can first send her a legal notice instructing her to refrain from indulging in such undesirable and unnecessary activities against her lest you will initiate legal action through police as well as through criminal courts of law.

If she is not stopping her such damaging activities, you may lodge a complaint against her for creating nuisance and torturing you as well as you can file a defamation case provided the ingredients of her complaint warrant an action under the defamation laws.

Can you please tell me if I have to file an e-FIR? If so, would you be able to guide me? I see a few options at http://www.delhipolice.nic.in/ but dont know which one to choose. Also will it affect me or my parents negatively? Do I have anything at risk? What will be your charges to send a legal notice to her and what will be the procedure?

First warn her by sending a lawyer's notice on the lines as suggested in my previous reply.

Wait and watch the developments, after which you may contemplate further legal action.
