• Stay on transfer order

Hi, My mother is having one year of retirement. She is working in medical department as female health worker. As per the government retirement age group she would have retired in 2016 but it got extended to 2018. Now she is been transferred to a locality which is 74 km away from Bhubaneswar. My mother age is 60 years and she is not physically strong to travel long distance. So kindly suggest what will we do and how to put stay on order.

1.At the time of retirement the transfer is not generally allowed though there is no legal restrictions if the Service Rules so allows.

2.Since your mother is not medically fit so she can submit representation on medical ground s which should be allowed.

3.if not then she can challenge this decisison in SAT or in high court.

She should make a proper representation to her higher authority narrating the facts of her ill-health condition and her last leg of service/superannuation etc, exhaust the remedies within the department and afterward she can plan to approach tribunal to obtain stay of the transfer order.
