• Conversion of land from agricultural to commercial

Hi, I have purchased 30*40 agricultural land Coorg district of Karnataka , while purchasing I have left around 12 MTR space from the center of the road , the land in situated in the state highway , and in our area as per PWD we have to leave around 12 MTR space for future road widening,while registration the surveyor also had the same comment ,also I have paid extra money for the 12 MTR and also mentioned in the agreement that 12 MTR space belongs to me untill road widening, now when I am applying for land conversion the MUDA is saying to things , 1st point is the 12 MTR space which has which is left for future road widening has to be registered to PWD / Panchayat, is this comment true?
2nd Point , Now they are saying that 12 MTR is not sufficient , I have to leave around 24 MTR space, how to know the exact space required to be left for road widening? If I leave 24 MTR space my 3/4 the of land will be gone.

as pr newspaper reports The new norms stipulate that 10 feet of land should be surrendered for free to the Mysore City Corporation (MCC) for ordinary roads and 30 feet of land given up to either the MCC or the MUDA if conversion was being sought for lands adjoining national highways, State highways or the ring road

2) The new norm insist on the landowners to compulsorily set aside 10 feet of land to facilitate roadworks if they wish to apply for land conversion. The extent of land stipulated by MUDA should be surrendered for free to the local body to take up roadworks, and without this, land use conversion applications would be rejected,

The requirement to leave at least 10 feet from the road to the construction would be basic requirement for approving conversion, however if this property belongs to you, the roadside space has to left vacant, it has to be complied with. This property can be transferred to to the PWD as per the existing rules.

However the demand for an additional same extent by the department may not be justified until there is ruling on it.

You may ask them to give the same in writing quoting the relevant laws in this regard.

Thank you sir, please confirm whether the 10 ft or 30 ft , should be left from centre of the road or from the edge of the road ?

If the property is situated near the state or national highway, you would be required to leave space to the extent that you may anticipate the authorities would acquire for road widening.

This should be left from the edge of the road leading to your property.
