• Refund of Advance

Dear All, on 22nd May I paid an advance of Rs 5000 for purchase of wardrobe costing Rs 41350. After 2 days i realized that the item is over priced and hence decided to cancel it. When I called them up and informed that I am willing to cancel the order, to my surprise they told me that 10% of Rs41350 ie total cost will be deducted and refunded. While paying the advance they never mentioned the same. After hearing that I raised a complaint in National Consumer Help Line. They told me to send them a letter by speed post, and ask them for full amount of refund. Now my question is 
(a) Am I eligible for refund.
(b) If yes then how to proceed.

1) you are entitled to refund . there is no provision in your contract that 10 per cent of total cost would be deducted

2) you cna file complaint against supplier before consumer forum seek refund of money paid with interest

3) also claim litigation costs and compensation for mental tortue undergone by you

4) you cna file complaint on your own

5) if you engage a lawyer litgation costs would be more than amount of refund claimed by you

1. Yes, you are very much eligible fort he refund.

2. So proceed with this Consume Forum helpline.they would ask for their attendance and would try to resolve the issue.

3.However such body has no adjudicatory power. So if seller refuses to pay then you will have to file a case before the consumer forum to recover the full refund.

Since the seller has come down to make full refund, yo may send him a letter to refund and get the refund or at least the reply that he will not refund so that you can proceed with either of his reply accordingly.
