• Completion certificate by development authority

I am residing at Green Park Colony, Bareilly in which more than 1000 houses are built by builder and sold ( under registered deed) to different buyers 10 years ago and the layout of the colony was passed by the Bareilly Development Authority but the developer did not apply for completion certificate and basic amenities viz water, light, cleaning etc are managed by the residents of the colony themselves and the said colony could not be handedover to Nagar Nigam in want of completion certificate and completion certificate is not issued by the development authority as builder/ developer has not applied for said certificate therefore now the questions is as to how the colony may be handed over to nagar nigam and how the said certificate may be obtained

File complaint against builder before consumer forum and seek orders to direct builder to obtain completion certificate / occupation certificate from development authority

The residents/owners of the flat to combine and submit a representation to the authorities to provide them with the basic amenities.

The completion certificate is essential to provide any amenity but without the builder applying for it the authority may not sanction because they would inspect the property and completion of construction, certify that the constructed building is fit for occupation and habitable in all the respects.

The combined effort by all the residents together with a representation would solve the issue or else to seek the court's intervention by filing suit against the authority to issue the same after due inspection.

Kindly inform remedy to solve the said problem

As suggested, in the absence of the developer or if you are not able to trace the developer, then all the flat owners to combine and give a joint application to the authority to solve this problem, or o the advise of an advocate, you can file a suit before the concerned civil court seeking the desired relief and remedy to this issue.
