• Validity of OBC certificate

I have done my complete schooling in Jharkhand. My father belonged to Bihar and we had moved to hazaribagh 1990 in which now falls in Jharkhand. We got a property in Jharkhand in 2000. I was told that by the authorities that I can't get an OBC certificate from Jharkhand because of khatiyan. Am I eligible to get the certificate from Jharkhand. Do I ORIGINALLY RESIDE in Bihar as per the Constitution. If I get it from Bihar, is there an adverse legal consequence?

Since you have been originally domiciled in Jharkhand you are entitled to any certificate from the state of Jharkhan only.

Now of your father is OBC and does not belong to creamy layer then you are entitled to OBC certificate.

I am not sure what doyou man by Khatian.

If the competent authority refuses to issue OBC certificate for reasons which is supported by law then you can filewrit petition in high court for necessary relief.

the following documents are required for issue of OBC certifcate

pply through Tehsildar

Filled application form along with a court fee ticket of Rs. 2

Two government officer or gazatted officer signature on the certificates in the application form

Attested copy of the Ration Card

Report of the concerned Patwari or Tehsildar

Income certificate.

Residential Certificate

Photocopy of Khatiyan showing Caste

Any Revenue Record where caste of Applicant is mentioned

Proof of Relationship of applicant with the Khatiyan Owner

Affidavit by the Applicant stating the authenticity of the enclosures

In case Government Official copy of Service Book mentioning the Caste

Since your root is in Bihar, the authorities in Jharkhand may refuse to issue you the desired certificate.

However if your community comes under the state list of OBC and you have evidences to prove that you are a bonafide resident of Jharkhand, the authorities should not refuse to entertain this application, you may fight it legally also.

However in order to mitigate the problem, you can get a certificate from Bihar also and it is valid provided if your certificate is genuine.

The permanent address of the present address is not a matter of concern.

You may write permanent address as Bihar and the Jharkhand as present address.

You can obtain bonafide residence certificate from the local SDO as per requirement which would solve the problem.
