• Fraud transaction from online banking, bank denied to pay

Hi,

I got a message and phone to share SIM # to update services otherwise number will be blocked. As SMS came from service provider and call from fraud person as a customer care. I shared it but suddenly i realized i did mistake and nothing is working in my phone. I immediately rush to phone number service provider which is airtel and changed the sim within and hour and as per rule of airtel new sim update takes 4-6 hours for activation and 48-72 hours for SMS activation. 

Within same day fraud transaction happens around 1 lakh and i called banking customer care which is ICICI bank to block the transaction for all purpose and they have blocked transaction including card for all purpose this is what told by customer care, in general i updated him that i have changed my sim so i will not receive any sms in next 48-72 hours. Meanwhile my ICICI account was hacked by hacker and changed my email and phone so i was not able to even login or was getting any alert through email or sms.

When i called next day customer care twice and he confirmed that everything is blocked but i got a call from one of the hackers that your transaction is still happening then suddenly i called customer care and they confirmed that additional transaction of 2 lakh done. After all the talk and conversion submitted FIR copy along with complained bank assured me to wait till 45 days to get another update or solution.

After 45 days bank has closed my case and i have no update. I am feeling cheated. Please suggest me.

As per the Master Circular of the RBI the bank where the fraud has occurred is bound to compensate the customer.

The online fraud also comes under this Circular.

So take hep of this and if the bank still refuses top pay then file writ petition in high court.

Taking advantage of this I have recently managed to give number for my clients on such frauds.

1) you have already lodged FIR with police regarding fraudelent transaction

2) on absis of your complaint police will carry out investigations

3) if inspite of you blocking your card additional transaction of Rs 2 lakhs was done then you should file complaint against bank before consumer forum and seek orders to direct ICICI bank to credit your account with Rs 3 lakhs fraudelently debited from your account

Such types of fraudulent activity are going on in a mass scale.

It i the customer who has to be careful.

The bank will ultimately raise their hands stating they are helpless.

However the fact is that due to bank's casualness and lethargy towards an immediate rectification has caused you more damage and loss.

If the bank had taken prompt action the further loss could have been avoid.

The bank will not have any reply to this question because the staff who work there are either less qualified or they just work there as a formality without any dedication to the job.

Even the customer care staff in most of the service providers are inefficient or reluctant to help the people they are supposed to support their customer's problems.

All these cause great loss to the customers like you and the service provider will not be bothered for any personal approach by any customer.

The solution for this is initiate proper legal action against the service provider through consumer court.
