• Reg: Adding of Katha to Sales deed

Hi,
I have bought a flat recently in BMRDA location and I have registered sales deed with builder during April 2016. The katha for my flat had been applied for by the builder but, I received this during August 2016. This katha is in the Builders name. When i am trying to do a katha transfer, the panchayat told me that i need to link the katha number in my sales deed and then do a transfer.

For linking this when i enquired with the registrar, i was told that it will require a supplementary deed and it would cost me 1% of the property value (sales value). Kindly let me know how much i need to pay and the legal procedure for this?

As per my understanding it should cost me only nominal stamp charges since sale has already happened.

For Transfer of Katha from one person to another based on the documents like sale deed, will, gift deed, family partition, release deed, in respect of properties already having khatha:-

Application in prescribed form

Title documents, flow chart of the title

Copy of upto date tax paid receipt

Affidavit regarding / inheritance / gift / court decree./ purchase of flat

Original Death certificate in case of Kathadar’s death

You should catch hold of the builder/vendor to get the khatha transferred to your name.

If you already possess registered sale deed then you dont need to have any supplementary deed, it is not understood that to which supplementary deed is the registrar referring to.

Panchayat board is not the authority to issue khatha.

If the khatha is still in the builder's name, then he has to arrange to get it transferred to your name, at least he has to help you sort this out, by guiding you properly.

You can take the help of an advocate in the local and try to initiate steps legally if the builder is not cooperating.
