Dear Sirs,

I am booking a property in Apna ghar phase 2 project at mira road. And 1st slap is almost completed out of 14 slaps.
So now they ask me for the 20% payments + service tax as 1st payment, and they told me that now they are doing registration till 6th floor flats and for above that registration will be done after 4-5 months and that time will have to pay duties and registration.
Can you please help me to know to find out if it is genuine???

1. First of all do not go for any payment unless and until a formal agreement for sale is executed between you and the builder.

2.Tofind out the slab constructions details do ask for sanctioned building plan.If you find that the Municipality has granted permission to construct upto 14 floor then you can for constrcution linked payment olan.

3.However do get the deeds checked by a local lawyer beofre taking the decision.

1) check whether building plans are sanctioned by muncipal corporation

2) whether IOD / commencemenet certifcate issued ?

3)builder must have entered into agreement for sale mentioning schedcule of payment

4) check with sub registrar office whether any agreement for your project has been regsitered or not

Any construction of this nature will be deemed to be completed only when it is fully completed in all the respects and the builder obtains OC/CC from the concerned authorities after completing the construction.

There is no point in paying the charges the builder keeps demanding without completion of the entire complex because it will not be possible to get the incomplete work completed if you are taking possession urgently.
