• Question on divorce

Thank you kaanon for answering all my previous enquiries. I have one more problem. When i was residing with my husband in 2015 he told me to make his salary account jointly operated with me. On his oral consent i did it without taking any written NOC. I work in state bank of india. So i did it on good faith on my husband. Now after exactly two years of making it joint he gave a letter to my bank that he dnt know how his account is joint, whether his consent was taken in written or not. But i have none to show. 
My date of marriage 27/2/15
Date of account joint 10/3/15
Date of separation from my husband 09/1/16
Date of filing divorce 27/2/17
Date of questions raised to bank 13/4/17
He says he dnt know anything but yet last two years he is doing full transactions. Its hard to believe. I even handed him a joint passbook but he says he dnt have any. What should i do now.

1. Apply for bank transactions from bank or you can get it online.

2Form this his bank transactions will be apparent. Show this to court.

3 You can file case of theft and criminal breach of trust u/s 379, 406 IPC gaint him if you wish to reocver your money.

4.Do not let go your hard earned money so easily.

You need husband written consent to operate joint account

2) oral consent is no consent

3) in your defence take the plea that only on husband consent joint account was opened and it was operational for 2 years and husband was fully aware of it

The statement of transactions for the whole two years which was done by him shall be a substantial evidence to prove that he was very well in the knowledge of such an account.

He cannot claim any excuse or ignorance of law.

You can challenge his false statement on the basis of documentary evidences in your possession.
