• Passport and Marriage Certificate

We got the marriage certificate issued in 2014. The name of my wife was given as "A B C". Her original name on the birth certificate (and all other govt issued documents) is "A D C". Her middle name was changed before marriage in 2012. (She was adopted, so her middle name was changed). We had made affidavits, newspaper ads, etc for the same. When she went for issuing "Passport", her marriage certificate was rejected. Reasons: the adoption is not possible for any child after the age of 18 years. So basically her name change was deemed Invalid.
How can we proceed for getting "Passport"?

Note: My wife's name "A B C" is also added on my Passport.

It is true that after age of 15 years child cannot be adopted unless there is custom in community to that effect

2) revert to original name as reflected in the birth certificate

3) apply for rectification of name in marriage certificate. Rely upon birth certificate, school leaving certificate which reflects correct name

4) then apply for issue of passport for wife

To change the name in the passport, you have to apply for a "Re-issue" of passport and get the specified change done in the personal particulars.

The passport authority has nothing to do with the adoption deed.

No doubt the adoption of adult is not valid in law.

Instead of producing the copy of the adoption deed to prove the change of name, she could have produced the copy fon the gazette publication wherein the change of name was effected.

Now you have no option than to obtain a court decree after filing a declaration suit to declare the correct name of your wife by impleading the passport office as one among the respondents.

Will get corrections made in Marriage Certificate. Also can I get wife's name corrected in my Passport? Is is possible. I don't see any such provision on Passport Website.

If the passport authorities reject the application then you have no option than to approach court of law with a suit for declaration of name to be mentioned in the passport and all other relevant endorsements in the passport incorporating her correct name.
