• Ancestral land

Sir,
we have ancestral property at Kanchrapara West Bengal and we have been staying on the same property for more than 50 years. All the property were being look after by my grand fathers and after his demise we came to know that the all the property are only in the name of three stake holder out of total five stake holders as my grandfathers father were five brothers. Please suggest what to do?

It is joint family property bought for benefit of joint family

What is important is source of funds for purchase of property

Since you have been staying in property for 50 years you cannot be evicted without following due process of law

If you want to have a share in the property, you can file a partition suit as a coparcener through your father's share in the ancestral property giving the family genealogical tree or lineal descendancy accordingly describing your line and indicating your rightful share in the ancestral property.

1. Your quesry is not clear.

2. On whose names the property stands now? Who are the stake holders?

3. How the property is standing in the name of 3 brothers of your grandfather's father? Was there any gift/settlement deed in connection with the sauid property in favour of those stake holders?

4. If yes, then you shall have to challenge the said deed.

5. Conduct a thorough search in connection with the title f the property from the local Registry Office and then act according in challenging the deeds.

6. File a partition suit claiming division of the sad property to solve the problem for good.
