• Reliving letter from mnc

I have resigned from an MNC,where the notice period was 3 months but i was able serve only 45 days. My employer was not accepting for buy out option. Need help to get my reliving and experiance letter.

1) if you need the experience letter and relieving letter you have to serve the 3 months notice period

2) it is at the discretion of company to accept salary in lie of notice period

If you have given the resignation in the proper manner following the procedures meant for it as mentioned in the employment offer letter, you may proceed with your proposal to buy out the notice period if there is a clause in the employment offer letter to this effect.

After that if the employer is not giving you a relieving letter or experience letter you may escalate the mater in writing to the top management and seek his/her intervention to this. If you dont get a relief after this also then you may issue a legal notice demanding the same and then plan to initiate further legal actions as per law to get the desired reliefs.

If I am unble to serve, What legal steps can I take to get my reliving letter.

You may first make representation in writing to the top management explaining yor circumstances under which you are unable to serve the notice period hence you may ask him to permit you to buy the remaining notice period. If you dont get proper response then you may opt for legal action on this.
