False FIR registered, enquiry about cancellation
I was having a tenant. He was a fraud and was run away from my house from last 1.5 years locking his tenanted house by doing frauds with many people. I ask him to vacant my house on phone but he keep on fooling me by saying we will come in a month, week or so.. he stop paying rent as well..one day he call me and agreed to vacant my house by sending a letter duly signed by him..in that letter he requested me to transfer his house material to one of my godown and promise me to come within a year and settle all dues..on his written request i transfer his house material and take possession of my house. Next day his wife along with a lawyer come and make sceen in front of my house and try to prove that letter a false and my there police contacts they file FIR of robbery, theft.. police had taken my neighbours statement that his material is not stolen, it is shifted to other place in the presence of many people..now its 2 years gone and police had not filled any chargesheet neither they are interested in any thing... now how can i cancell this FIR that is a black spot on my status..tenant is still missing and his material is with me. He is demanding rupees to take his Fir back..please tell me what is the procedure to cancell it..and how long a police will take to file chargesheet..

1. Though to cancel the FIR quashing is an option , it is better if you wait till submission of charge sheet.
2.if there is delay in fling charge sheet you can file writ petition in high court.
3. If the amount of money is not substantial you can compromise. Else fight the case on merit.
Police is not interested in anything..whenever i meet IO he don't show any interest and try to escape from enquiry..is it possible that FIR is being cancelled as he may have file a cancellation report and had not told me..because when i check online status of my FIR it shows no record exist..how can i know if the FIR still exist if it is not in delhi police site record..also suggest me a lawyer who can cancell my FIR in delhi with cont. Numbers...thanx

1. if the police want it cna file closure report in court. So persuade the police to do so.
2. Send a RTI application to know thew actual status of the case.
1)police can after inquires file closure report
2) you can atake search in court records as to whether any such closure report has been filed or not
3) number of lawyers on this website from delhi

You can file a petition under section 482 cr.p.c. before high court seeking to quash the FIR pending in the local police station.
If you have to file a discharge petition then the police should file the charge sheet before the trial court which is not happening hence a petition to quash before the high court would be the best choice.
Dont give him any money, let the case go on, you can challenge the same based on the evidences and merits in your side.
You can verify the status of the FIR from the court where this FIR was submitted by the police.
If it is till pending for filing charge sheet, you can file a petition before the same court to expedite the trial proceedings since it is pending for more than two years.
