• Online payment processor Paypal took money back earned from job

Thanks for reading my query. I am a freelancer working from home. I had one client for which I worked as a virtual assistant. He paid me through PayPal. I was working for him since December 2014. We didn't have any formal written/mail agreement. He was just paying me for hours I worked in particular month. When I asked him to send job invitation to my email, his company details etc then he threatened me like he will file payment back dispute in PayPal. He did so 10 days back. Now the balance is negative. PayPal given him favors despite I have all job proof(Skype Chat), PayRoll Software log etc. I just don't have any written agreement but I have work proof. How can I get paid back? Please, advice.

This is typical problem with the online payment.

Raise dispute with the paypal on submission of all the proof oyu have against the client.

If the Paypal does nor reverse the payment in your favour you can file case of criminal breach of trust agaisnt the paypal official.

Since your client stays in abroad you can not file any case agaisnt him.

This is the problem with online assignments when there is no specific agreement.

As long a thing are going on smoothly nobody will other about the law or the consequences on such deceits.

Once a deceitful act emerges or fraud surfaces then only the legal aspects shall come to the knowledge.

Well, since you have evidences and records for the tasks you had undertaken as well as details of completed task, you may issue a legal demand notice instructing him to pay you the dues for the assignment/tasks completed by you.

Wait for his reply/response and then decide about further legal course of action for recovery.

1. Do not worry as if you discontinue this account then you need not pay any money to Paypal.

2If in future you get any money from another client through Paypal then that amount may get adjusted.

3.So do ensure that you do not use Paypal payment gateway in future.

4.Ignore the demand of client and Paypal in future and they could do nothing.

1) issue legal notice to PayPal to credit your account wrongly debited

2) in notice mention about email sent by customer to do the work and chat messages exchanged with him . Mention that payment was done by customer only after he was satisfied with your quality of work

3) if paypal fails to credit your account file summary suit under order XXXVII of CPC to Direct PayPal to credit your account

So I already took my money no issue. But now Paypal account showing Negative balance which means Now I owe PayPal $$$$. What could be legal issues if I don't pay? I don't want to pay because it is my hard earned money. I have all work proof,chat records and only one email from client but no formal agreements (Client disputed that I didn't deliver 16 websites to him, but in fact, I was doing hourly job, not even mention on 16 websites anywhere). What could be worst case for me. I don't even have job to servive now.

You do not pay anything to the pay pal organisation even if you receive a legal notice.

But make sure that you give a reply giving the details and the reasons that why you cannot repay since you have rendered the services and the payment was towards the services rendered by you.

Let them sue you, you can always challenge them and defend your case on the basis of merits in your side.
