Refund from builder

On an online search for residential property I found a property and contacted the agent through phone for enquiry about property. It was a Villa project. As per the direction of the agent I deposited some money as booking advance into the account of that builder for blocking a Villa. Because I am working in Bhutan and the property is in Kerala, India and I was not able to visit or check the Villa project for selecting a Villa. After one month I visited the plot in which the Project will start and his site engineers told me West facing Villas are available in the plot for booking. One week later after return from India I asked him to provide me plot for West facing Villa. But he told me that plots for west facing Villas are booked and not available. Now I am asking for refund of my money but he send an email to me for resending it to the company for refund request stating that the mail required to be send to company for completing official process for refund. The mail is as under. "I had booked a Villa in Chithanya, Kodumbu . I had paid an advance amount of Rs.50,000/- . Due to unavoidable reasons I have had to cancel the booking. I kindly request you to accept my request for cancellation and refund the advance." My question is why should I send such an email for refund request as neither they did not provided any Villa nor I booked any Villa. What to do for refund from the Company?
