Separation of a wing from a cluster of four wings in a housing society

I have a flat in Thane west in a big society. In our cluster there are 4 wings. 3 wings comprise of 3 BHK flats while in one wing there are 97 -1RK and 1 BHK flats which are modified as single 3 BHK flats presumably before formation of society in 2017. These 97 jodi flats have two registrations and TMC Approved Plans also show them as two separate units. For five years these 97 jodi flats were charged service charges & maintenance only for single flat. Last year one member complained to Dy Registrar about this violation and Dy Registrar gave directive to society to follow bylaws 65 to 71 for calculating various service charges and consider number of units as per TMC approved plans and raise invoices to all the units. Our society took a decision from August 22 to follow the directive from Dy Registrar office and started raising two invoices for these 97 jodi flats. The decision was taken in SGM in 2022. The 41 Jodi flat owners out of 97, filed a writ petition in Coop court against the SGM decision. Their prayer to court was to reverse the decision of SGM as they claimed there were some minor errors in the re-calculation of maintenance done. They prayed for granting interim relief by charging maintenance as was done upto July 2022. Simultaneously while the petition was under hearing, the 9 MC members ( including Chairman and some members who were owners of jodi flats but were paying for single flat, along with a few others who were their supporters from other wings); went to DyR and resigned all together which resulted in DyR putting an AO in our society. Also Jodi flat owners gave application to DyR for their separation from our society. So our society is in mess now. COOP COURT SURPRISINGLY GAVE STAY ORDER AGAINST THE REVISED BILLS WHICH WERE COMPLIANT WITH BYLAWS AND ASKED SOCIETY TO REVERT BACK TO JULY 22 CALCULATION WHERE THESE JODI FLATS WERE CONSIDERED AS SINGLE. AO already completed 6 months in our society on 16th April 2023. He is least bothered about our society’s maintenance and hiring new agencies with higher costs . The primary job to hold the election is being ignored by him completely. After many visits to DyR in groups from our society with signature campaigns for our own governing body now we heard that 11 June AO is calling SGM. No formal information has been received so far. Yesterday 25th May we get a post from the previous chairman of the society who is also an owner of Jodi flats PROPOSING SEPARATION OF ALL THE WINGS NAMELY A,B,C AND D. He is asking us all to agree upon his proposal. We all do not want separation as it will cause lot of troubles handling common amenities. Court while giving judgement said that opposite party will not be affected by stay order granted. My query is 1. Can we change our existing lawyer ? 2. Can we take actions against AO? 3. HOW CAN WE AVOID THIS SEPARATION.???( the final verdict of the court is yet to come.).
