Technical Resignation Regarding - Issues with NOC

Respected Sir, I am a UPSC selected candidate serving as a Doctor(Specialist) in a Delhi Government Hospital for past one and half year. Before Joining the hospital, I had applied for another post of Astt. Prof. in Medical College (Delhi) though UPSC only. Due to unawareness, I didn't inform in my hospital administration that I had applied for another post in UPSC. Now after one year I got an interview call and immediately applied for NOC in my hospital. But the hospital authority (MS) didn't consider it even after giving an apology letter in writing. He tried to ignore this saying that he doesn't hold the authority to provide NOC, but I, somehow arranged the circular in which it was clearly written that he is authorized to provide the NOC. After lot many requests, MS issued the NOC and said that "this is only for your interview and if you get selected, you will have to resign from this post and will have to join as fresh in your new role. He also mentioned that even if you ask for NOC for technical resignation, I will not forward your file for further processing, you can file a court case against me and I will be called but remember it will take at least one year." This shows that he has some personal problem with me but I am totally blank why is it so. I am now selected in the UPSC again and want to join in medical college. As per the rules I will have to provide the NOC at the time of joining. Will the NOC provided by MS will work in this case for technical resignation? Or should I give another intimation to the hospital management for another NOC? in that case if he doesn't forward my file, then should I file a case in court. Even if I file a case, I can foresee that it will take a long time and by then my joining date will be crossed. May I give a direct resignation and then join, and based on the court verdict, I claim for the consideration of technical resignation at a later stage (It seems hard to be considered). My humble request from you to please guide me through.
