Police Action under COPTA 2003, Section 4

1. Can a person be taken to a police station in a police jeep and threatened to be produced in the court for smoking a cigarette next to a paan shop? 2. This happened with me recently, and the others were being rounded up too (Navi Mumbai). 3. When people start pleading, they demand a fine of ₹200 in a bossy manner, and let go after filing an N.C.R. 4. I told them they're free to produce me in the court, and they were pissed off because of that. To which one of the sub-inspector, said, "Iska 2 banao!" (2 N.C.R.s). They were not even willing to show the N.C.R.s, and I had to insist to let me take pictures of it. They only showed me one. For other, one of the sub-inspector was like other one is just a copy, "Itna bhi bharosa nahi hai hum pe?". 5. In the N.C.R. who's picture I managed to click, they have mentioned that I was smoking at the "Bus Depot" even though I was 200 meters away from it. 6. They served me with a notice to be present at the district court at 10 AM (even though the court opens at 11 AM). 7. The personnel from the police station, where the N.C.R. was filed, himself didn't show up at the court. I got to know in the court after interacting with a couple of staff there, that a policeman is supposed to come, do the paperwork and collect the fine from me. 8. The reason I'm asking this question here is to know two things: 1. Does this qualify as misuse of power by police? 2. What repercussions I might have to face? (for example, passport re-issue)
