Registration of housing cooperative socity in Bhopal

Dear Sir, we live in a society in Bhopal, Madhya Pradesh, where there are 426 flats. The construction and maintenance of this society was being done by the builder from the year 2012, which remained smoothly till the year 2017 but as the builder's many work was completed and his almost flats were sold, the quality of its maintenance gradually decreased and when Sudden maintenance charges increased by builder in the month of November 2018 It was increased from 750/- to 1500/- and its information was posted in the standee at the main gate for all the residents. that give the maintanace charges 1500/- if not given then all the service will stop. When all the resident strongly opposed to giving 1500/-, the builder suddenly stopped the whole system operation. In that difficult time, with the mutual written consent of all the residents, the residents themselves decided to run the operation of the maintenance system of this society, and in this regard, there were frequent meetings of all the residents and finally this decision was taken and the builder was persuaded. For the next three months, the maintenance fee should be 750/- per month paid by the resident to builder in this three months learn with the builder's staff how to conduct the maintenance of the society so that any resident There should not be any problem and the arrangements should go on smoothly *(It is necessary to inform here that only the work of operation of the system was taken from the builder from March 2019 and not the entire society was taken over because its arrangements were not correct and the builder's Many works were also pending by him such as parking issue, tank for proper arrangement of water, problem of sewage line, painting the exterior walls of the building, etc., for which many correspondences were also done etc. But builder did not give any proper response. after that All residents electing some members without any registration under their supervision, to operate the system of maintenance of the society and they did good job without any compensation. After that, with the consent of all the residents, for transparency, we registered a socity under a common firm and society act 1973, so that the income and expenditure of all the maintenance support amount can be accounted through the bank. Due to the arrival of Covid in 2019-20 and 2020- 21, nothing could be done ahead, now all the residents want this society to be registered in the resident cooperative society. Your advice is needed whether any action can be taken against the builder regarding the pending works even after the formation of the resident cooperative society or the society will have to give NOC to the builder for resident cooperative socity registeration. The builder is currently handling the sewage work only on the condition that we are doing the maintenance which costs about 70000/- per month. Can we residents fight for our rights with the builder even after the formation of cooperative society.
