Is court order required to change place of birth in Passport???

Dear Sir/Madam I’m an Indian citizen, holding an Indian passport living in USA under work permit visa. I have a situation where my Birth Place in my passport is incorrect. Recently I approached Indian passport Center in New York to get it corrected. I was told to submit a court order issued by a judicial officer not below the rank of 1st Class Magistrate in India. As cited in the “Documents Requirement” in “Passport Seva”, court order is required only if change in DoB is more than 2 years or in case of conflicting documents/ if change in place of birth involves change of State or Country. The change related to my place of birth is within same State(Tamilnadu) and I have my original Birth Certificate with correct place of birth issued by Government of Tamilnadu. How should I proceed with this matter?
